ACCIDENT WAIVER AND RELEASE OF LIABILITY AND INDEMNITY FORM

            In consideration of TailorFitCycles, LLC (“TailorFit”) permitting the undersigned to take a certain bicycle for a test ride (in each instance, the “Bike”) as a demo  (collectively, the “Demo”), the undersigned hereby agrees as follows:

The undersigned, for himself/herself, heirs personal representatives or assigns, does  HEREBY RELEASE WAIVE, DISCHARGE, ASSUME ALL OF THE RISKS in connection with the Demo and any and all activities in connection therewith, including without limitation, any risks that may arise from negligence or carelessness on the part of TailorFit, or its representatives, employees or agents being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault, including any manufacturers defects that may exist with the Bike.

            I acknowledge that this waiver will be used by Tailorfit in connection with the Demo and that it will govern my actions and responsibilities in connection therewith.

            In consideration of my willingness to participate in the Demo, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A)  I WAIVE, RELEASE, AND DISCHARGE TailorFit and/or its employees, representatives, and agents from any and all liability, including but not limited to, liability arising from the negligence or fault of TailorFit or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me;

(B)  INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE, TailorFit or persons mentioned in this paragraph from any and all liabilities or claims, actions, suits, procedures, costs, expenses, damages, including attorneys fees, as a result of taking the Bike for the Demo, whether caused by the negligence of TailorFit or otherwise, and agree to reimburse TailorFit for any such expenses incurred. In addition, the undersigned agrees to reimburse TailorFit for any damage to the Bike that occurs during the Demo, as a result of the undersigned's gross negligence.

This form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
